The law goes on to say, “The fact that a person charged with a violation of this section is or has been entitled to use a drug under the laws of this state shall not constitute a defense against a charge of violating this section.”
This means that even if a driver was under the influence of a valid prescription drug or over-the-counter medication, he or she can still be charged with DUI. When it comes down to it, if a drug affects the driver’s ability to safely operate a motor vehicle, the driver will face DUI charges.
