DUI refers to more than just driving under the influence of alcohol.  In the state of Washington, drivers can also be charged with DUI if they are found driving under the influence of drugs. The Revised Code of Washington (RCW) section 46.61.502 clearly states:

“A person is guilty of driving under the influence of intoxicating liquor or any drug if the person drives a vehicle within this state:

(b) While the person is under the influence of or affected by intoxicating liquor or any drug or (c) while the person is under the combined influence of or affected by intoxicating liquor and any drug.”

The law goes on to say, “The fact that a person charged with a violation of this section is or has been entitled to use a drug under the laws of this state shall not constitute a defense against a charge of violating this section.”

This means that even if a driver was under the influence of a valid prescription drug or over-the-counter medication, he or she can still be charged with DUI.  When it comes down to it, if a drug affects the driver’s ability to safely operate a motor vehicle, the driver will face DUI charges.
